We're delighted to have received full planning permission for these two premium 4 bedroom properties both with detached double garages, on a development plot in Brixham for a longstanding developer who we've worked with over the years. 

The site already had planning permission for a single dwelling but by the council's own admission the density of housing approved wouldn't be high enough to support housing on the site following recent changes to the NPPF and they would actively support an application for multiple units on the site.

The site already had planning permission for a single dwelling but by the council's own admission the density of housing approved wouldn't be high enough to support housing on the site following recent changes to the NPPF and they would actively support an application for multiple units on the site. 

Following a subsequent planning permission for 20 units on an adjacent site which had previously been split up by the former owner, the council took the view that this proposal could be reasonably considered an additional phase of development of contiguous sites in combination by the same owner (as the 21st and 22nd dwellings). As such they considered that the two applications could be considered as phased delivery of the now subdivided plot and an affordable housing contribution would be required. 

Keegan and BASE's expert experience in this area meant he was able to successfully argue that in light of the planning history, established use of the site and past ownership, the site has not been artificially subdivided in seeking to avoid affordable housing requirements, and that the applicant seeking to develop the site in isolation and separate to neighbouring approvals. A view which today has been accepted by the council's legal team.
